Last week, Kamrath Law Group attorney Katie Rindfleisch successfully argued a departure motion in Hennepin County.  Her client, a young man, was charged with being an Ineligible Person in Possession of a Firearm, a very serious offense that carries a mandatory minimum prison sentence of 60 months.

Ms. Rindfleisch presented several substantial and compelling reasons to the Judge as to why her client did not deserve to go to prison.  The Judge agreed and stayed his prison sentence.

Attorney Luke Rezac Wins on a Motion to Compel Discovery

On March 20th, 2012, Kamrath Law Group attorney Luke Rezac argued in front of the Honorable Judge Michael Fahey in Scott County District Court, to compel the State to allow him access to investigate vital issues pertaining to a Rule 20 Psychological Evaluation ordered by the court. The State vehemently opposed Mr. Rezac's argument, but the court found in favor of defense counsel and ordered the State to allow the investigation Mr. Rezac was arguing for to be conducted.

Psychological Evaluation ordered in Scott County Aggravated Robbery Case

On March 6, 2012 before Honorable Michael A. Fahey in Scott County, Attorney Luke Rezac requested a Rule 20 Psychological Evaluation for his client. Mr. Rezac’s request was granted. The client has been charged with Aggravated Robbery in the First Degree, as well as 4 other counts of Aggravated Robbery in the First Degree in two other counties, along with 2 counts of Kidnapping. After many meetings and discussions with the client, Mr. Rezac and his client both agree that a Rule 20 evaluation in the next appropriate step to investigate and gather information in preparation for trial.

A Rule 20 Evaluation determines a defendant's competency to stand trial, and/or whether the defendant suffers or suffered from a mental deficiency or illness, either at the time of the alleged offense or is presently suffering from such deficiency.

Continuing Education

The attorneys at Kamrath Law Group have spent some time learning new things lately. Last week was a seminar called "Expect the Unexpected" - a discussion about trial strategies in murder trials. The attorneys got a lot of good ideas for some upcoming cases.

Last week was also a day-long conference on the current sex offender civil commitment laws in Minnesota. The conference was attended by legal, medical, and correctional professionals. There is certainly a shared concern about the current law. The conference provided our attorneys with some valuable knowledge that we can share with our clients.
